Today four folks had court today who were arrested in Oakland at the anti-Trump protests immediately following the election results. All four did not have charges filed. Great news!
Here’s the deal with charges not getting filed: This circumstance should never be confused with charges getting “dropped.” The district attorney (DA) has up to a year to file charges. It is best practice for defendants to check in with the DA semi regularly to make sure they don’t have a warrant, and keep their address up-to-date with their office. This way -in the event that one did get a charge!- the defendant wouldn’t miss their court date. It is extremely common for protesters to have their charges “not filed.” More often than not, charges are never filed. But in the event that charges are filed over the course of the year, please remember to contact the NLG (and us!) so we/they can track your case and support in whatever way we can.
